Mohit sexena : THE pressure on the rupee will continue as long as the stalemate in the European debt crisis lasts and the policy paralysis continues in India, according to forex experts. That the Reserve Bank of India (RBI) does not have sufficient reserves to support the rupee will add to the woes in the coming days, say bankers.
The economic slowdown, rising fiscal deficit and the widening current account deficit will continue to dent investor confidence.
Worries that the European debt crisis could exacerbate the slowdown in India will continue to put pressure on the risk-averse foreign institutional investors (FIIs). This is resulting in dollars being drained out from emerging economies like India.
On Tuesday, the rupee fell to record low of Rs 53.52 a dollar but pared some of the losses to close at Rs 53.23, down 0.7 per cent from Monday’s close of Rs 52.84.
Jamal Mecklai, chief executive officer of Mecklai Financial Services, told Financial Chronicle that the rupee was being battered by the European crisis. “We are no longer insulated from the European crisis, and unless some solution to the debt crisis emerges there seems to be no support for the rupee. The lack of reforms and inflation will continue to make investors risk averse.” He, however, did not hazard a guess on where the rupee could go.
The currency fell to Rs 52.73 on November 22, and is down nearly 17 per cent from its peak in July. In November alone, it lost 7 per cent, the worst monthly fall in over 15 years.
The volatility of the exchange rate is a reflection of the health of the economy and the confidence, or rather the lack of it, that foreign investors have in India’s growth.
K Prabhakar, senior vice-president and research head of Anand Rathi, recently told Financial Chronicle that the situation would worsen immediately.
“RBI cannot intervene since it does not have enough money to do so. The rupee is expected to fall further to Rs 56 to Rs 58 in a few months,” Prabhakar said.
Vivek Mhatre, trading head of Union Bank of India, said, “Companies which have foreign currency convertible bonds (FCCBs) will be impacted first, particularly if the conversion is near, as the stock markets are down and they will have to settle the dues in dollars. Even exporters and software companies that have bought forward hedges will suffer, as they could not have hedged beyond Rs 49 or Rs 50 to a dollar. The volatility in the exchange rate is the reflection of the overall state of the economy.”
Partha Bhattacharyya, group treasurer with Essar Investment said, “On account of faltering domestic economic fundamentals like widening trade deficit and slowing growth, coupled with global risk aversion triggered by euro zone debt crisis, the outlook for rupee remains bearish in the short run. The weak rupee would add to the inflationary pressures in the economy. The outlook may reverse if the risk sentiment improves globally and Indian policy makers initiate measures to spur growth, which would attract foreign capital flows into India. Fundamentally, India continues to be a good investment destination."
Exporters aren’t really cheering. Sanjay Budhia, MD, Patton group and chairman of the CII national committee on exports, said, “It’s a myth that exporters gain when Indian currency falls. A falling rupee does not necessarily mean a gain for exporters. The ground reality is that as much as 90 per cent of this gain is taken away by imports or import parity rates. Extreme volatility on any side is not good for anybody.”
Ramu Deora, president of the Federation of the Indian Export Organisation, said, “About 50 per cent of exporters who had hedged their currency are at a loss as the cost of imported raw materials has gone up significantly. Exporters are not able to book raw material contracts or make long-term commitments on exports. This has resulted in lower industrial production.”
Companies across the board will be impacted as they would have an import or export or foreign currency borrowing or a forward contract.
Auto companies, already reeling under of rising commodity costs, are specially worried. “The falling rupee is hitting the bottom line the hardest as the industry is heavily dependent on imports. Manufacturers have no option but to increase car prices and most companies have already decided to do so in January,” said P Balendran, vice-president of General Motors India. General Motors plans to raise prices of its cars by up to 2 per cent. The increase for its highest selling Beat will be Rs 15,000.
Shashank Srivastava, chief general manager of marketing of Maruti, said both the falling rupee and the yen appreciation had put a huge pressure on the company’s margins. “We have to increase prices but when and by how much is what we have to decide.”
Jnaneswar Sen, senior vice president of marketing and sales of Honda Siel, said, “We hedge our exports and imports for a certain period. For a short term there is no problem. But in this case the depreciation has been going on for a longer period. This will impact our bottom line.”
The rupee tumble has a direct impact on IT hardware in India, Alok Bharadwaj, president of the Manufacturers’ Association for Information and Technology, said.
Sonata’s chief financial officer, N Venkataraman, said that companies that had kept their options open would see windfall gains. “But most companies would have taken forward at Rs 48 or Rs 49. Those that have FCCBs will find the conversion rates a matter of worry.”
Mindtree’s CFO, Rostow Ravana, said it is true that most IT companies will gain that cannot be sustained.
By Mohit Sexena : Anna Hazare's new call for the Right to recall parliamentarians isn't receiving much political support. Political leaders and constitutional experts say it cannot be implemented - But is there an example in other democracies?
Having called off his 13-day long fast on Sunday, Anna Hazare is now giving a lot of food for thought to parliamentarians. He now wants to work on a Right to recall - an idea that has already been rejected by elected representatives.
What if a MP is elected with 30 percent vote, 70 percent would then jump and seek recall. It was an idea that was dismissed by JP, said Subramaniyam Swamy, President, Janata Party.
It's impractical, can't implement even at Panchayat level. People who are advocating this need to understand India first," said Vyalar Ravi.
The first successful recall took place in 1911 of Mayor of Seattle, the recall of elected representatives is already in existence in 9 states in America.
Hollywood Star Arnold Schwarzenegger was amongst the most high profile individuals to have been elected in 2003, in a special recall election to replace then Governor Gray Davis.
In India, states of Bihar, Punjab, Madhya Pradesh are some of the states that has Right to recall at the Panchayat level.
Anna also wants the government to look at the possibility of evolving a Right to reject for the voters. It implies that at the time of voting, voters should also have the option - none of the mentioned parties.
"Right to reject seems relatively more practical," said Congress leader Salman Khurshid.
"When the larger issue of electoral reforms comes in, it can be considered in the larger interest of politics," said BJP leader Murli Manohar Joshi.
The government would definitely try to avoid another confrontation with Anna Hazare, it would not want to be on the wrong side of any people's movement. So in case of electoral reforms, it may well take a lead and not be caught on the back foot again.
By mohitsexenapbt : New Delhi: The CBI special court hearing the 2G scam case will give its decision on Kanimozhi's bail plea on May 14.
The Tamil Nadu Chief Minister's daughter had applied for bail via her high-profile lawyer, Ram Jethmalani, on Friday. The CBI opposed her bail plea in court today.
"Kanimozhi is the controlling mind behind Kalaignar TV. Behind the scenes, she took the decisions," Special Public Prosecutor UU Lalit told the court on behalf of the CBI.
"She had been in regular touch with Raja regarding the launch of Kalaignar TV. He lobbied with the Information and Broadcasting Ministry for permits for Kalaignar TV. Kanimozhi was the active brain behind the channel. If a family controls 80% stake in a company, it's hard to believe that anyone else can be the brain behind it," he added.
If denied bail, the DMK Rajya Sabha MP will go to jail. "Let us see what happens in court, she said as she arrived for the hearing earlier this morning.
Kanimozhi has been accused by the CBI of accepting a bribe along with her party man, A Raja, who was Telecom Minister and is now in jail for allegedly designing India's biggest scam birthed during the allocation of spectrum and licenses in 2008. (Read: Who is Kanimozhi
In court on Friday, Kanimozhi appeared relaxed and was seen smiling as she talked to her husband and senior leaders of her party like TR Baalu. Not everyone was as collected though - a DMK MP named Adi Shankar fainted in court.
Kanimozhi told NDTV on Thursday that she does not expect "leniency or special treatment because she is a woman." All the people chargesheeted in the 2G scam so far have been denied bail and are in jail, among them the executives of some of India's biggest telecom companies. Mr Jethmalani, however, said that legal guidelines state that "women, old people, children should normally be granted bail." Listing the reasons that his client qualifies for bail, Mr Jethmalani said, "She's a law-abiding citizen, an MP and a woman." (Watch: 'Prepared for worst,' says Kanimozhi)
He also said that Kanimozhi is being targeted because she is the daughter of M Karunanidhi, who heads the DMK and is hoping to be re-elected as the Tamil Nadu Chief Minister - the results of the recently-held elections will be declared on May 13.
Ms Kanimozhi is part owner of a TV channel that allegedly became the landing strip for a 214-crore bribe paid by a telecom company to Mr Raja in return for a mobile network license and spectrum. She has argued that she was not an active participant in the company. The CBI has refused this explanation in its chargesheet. In an interview to NDTV on Thursday, Kanimozhi said that she is "prepared for the worst" and will respect the court's decision.
Mr Jethmalani said on Friday, "The allegation is Swan Telecom paid a bribe to Kalaignar TV. Assuming for a moment that it was at Raja's instance that Swan paid Kalaignar TV, what is the offence committed here? She's just a shareholder in the company. Not even a majority shareholder. She just has a 20% equity. The CBI is trying to create prejudice against her." He stressed, "It's only the Board of Directors who control the company and they alone can be held for criminal liability." Mr Jethmalani passed the buck for the financial affairs of Kalaignar TV to its Managing Director, Sharath Kumar. Like Kanimozhi, Mr Kumar owns 20% of the channel and has been chargesheeted by the CBI. (Read: Will DMK sacrifice Raja to save Kanimozhi

By mohit:The former Union Law Minister and senior advocate, Shanti Bhushan, on Monday moved the Supreme Court for a directive to initiate contempt proceedings against the former Samajwadi Party leader, Amar Singh, for allegedly fabricating a compact disc containing his conversations with him and party president Mulayam Singh.
In his application, Mr. Shanti Bhushan said: “The alleged contents of the CD have been fabricated with a malicious intention to interfere with the administration of justice as it tries to create an impression that a particular Bench of the Supreme Court [one of the judges of this court has been named in the CD by the contemnor] can be managed through the informant's son [Prashant Bhushan].
“The object behind fabricating the said CD is quite sinister as the attempt is apparently to derail the hearing of all important cases being/have been argued by the informant's son — before that particular Bench [of Justice G.S. Singhvi and A.K. Ganguly] — and thus, interfere with the administration of justice and to attempt to interfere with the continued hearing/judgment in important cases of public interest in which judgment has been reserved by that particular Bench,” he said.
Mr. Shanti Bhushan pointed out that one of the public interest cases in which judgment was reserved was that relating to the release in the public domain of the contemnor's tape-recorded conversations. “The attempt seems to be to try and make the judge recuse himself from the case by adding his name and suggesting that Mr. Prashant Bhushan is on very good terms with the judge and is in a position to influence him. This is totally false, and the scurrilous suggestion is a clear attempt to embarrass the judge and to interfere with the administration of justice.
Quoting from the reports by two renowned laboratories to show that the CD was fabricated through splicing of different conversations, he said: “Once it becomes clear that the CD is fabricated, the question then arises as to who has fabricated this CD.
He said: “It seems clear that Mr. Amar Singh must be involsexenapbt@ved in this fabrication as he states in the purported conversation that Mr. Shanti Bhushan is sitting with him. The fact of the matter is that the informant has never met the alleged contemnor, and, therefore, if this sentence is continuous and is, as it seems to be in Mr. Amar Singh's voice, then clearly Mr. Amar Singh has either engineered the CD or has cooperated in its fabrication. Thus, he has been made an alleged contemnor in this information which is being led before this court.
He said: “Further, such a CD could only have been made with the help of various other persons, including experts in the field, and this is the result of a clear conspiracy. It is thus imperative that an investigation be directed to be done by a special investigation team which will… establish who are the persons involved in this serious conspiracy to interfere in the administration of justice.
The applicant said “the act of fabricating the CD and then sending it anonymously to various news channels and newspapers is a serious attempt to bring not only the informant but also the judiciary under the cloud, and needs to be taken serious cognisance of.

ward winner activist, along with supporters, reached Mahatma Gandhi's memorial at Rajghat at 10 a.m., after which he is expected to stage a march from India Gate to the Jantar Mantar, a stone's throw from Parliament House, where Hazare will begin his fast.
Those accompanying Hazare include Right To Information (RTI) activist Arind Kejriwal and former top cop Kiran Bedi.
"I will fast unto death as announced earlier, as the prime minister has refused to form a joint committee with civil society members in it for the formulation of the Lokpal Bill. Even if I lose my life, I will have no regret, my life is dedicated to the nation," Hazare had said at a press meet earlier.
Hazare and several other civil society activists are pressing for adoption of an alternate bill, called Jan Lokpal Bill.
The Jan Lokpal Bill calls for setting up ombudsmen - Lokpal and Lokayuktas (in states) - independent of the government's control in order to check corruption in public life.
Activists say investigations by ombudsmen should be completed in one year and there should be a minimum jail term of five years and maximum punishment of life imprisonment.
The government's version, however, recommends a prison term of a minimum six months and a maximum punishment of seven years for corruption.
Hundredrs of supporters have already gathered at Rajghat, India Gate and Jantar Mantar where Hazare will be staging his protest march.
Prime Minister Manmohan Singh had Monday expressed "deep disappointment" over Hazare's decision to go ahead with the planned hunger strike, but said he had enormous respect for the social worker and his mission.

By mohit sexena-New York, (ANI): An 11-year-old American schoolboy, Osman Daramy, has been arrested and charged with assault as a hate crime for trying to rip the religious headscarf of a Muslim classmate in New York.
The boy, a sixth grader at Berta Dreyfus Intermediate School, has a history of harassing the girl, taunting her and threatening her on at least four separate occasions, police said.
The girl alleged that Osman and an unidentified girl tormented her for three months.
"They just attacked me. They called me terrorist. They called me Muslim. I'm afraid they might come back and beat me again," the New York Daily News quoted the girl, as saying.
"They kicked and punched me. I said, 'Leave me alone'. And he said, 'I won't.' He tried to pull off [my head] scarf, but I grabbed it and it didn't come off," she added.
Osman was charged with third-degree assault as a hate crime. Cops are looking for his accomplice.
Prosecutor Theresa Wilson described Osman as a pre-teen terror who harassed the same female Muslim classmate four separate times.
In the first attack, Osman "approached the victim and asked her if she was Muslim", Wilson said.
"She said leave me alone. The defendant then punched and kicked the victim. The defendant said she had a bruised lip and that her mouth was busted. It was not one incident. It was a continued course of behavior," she added.
Meanwhile, Osman's father Frank Davies said that he couldn't be responsible for a hate crime because he is Muslim.
"How could a Muslim have another hate crime against another Muslim? Osman is a Muslim...He's just a regular African kid. That's why they are out to get him. He's a victim," Davies said. (ANI)

By Mohit sexena-MUMBAI:chief of Mumbai Regional Congress Committee, is entangled in a fresh controversy following the disclosure that the controversial city-based realtor, D B Realty, deposited Rs 4.5 crore in the account of his son Narendra Mohan.
The details of his links with D B Realty, whose co-promoter Shahid Usman Balwa is in jail in connection with the 2G scam, have come to light in response to a PIL filed by RTI activist Sanjay Tiwari in Bombay High Court.
According to bank documents, the statement of Samata Sahakari Bank accounts in the name of Narendra Mohan and his wife, Ankita, show four deposits by D B Realty, amounting to Rs 4.5 crore during 2008-09.
On March 3, the High Court directed Enforcement Directorate, Income-Tax department and anti-corruption branch to investigate Kripashankar Singh's business dealings with Balwa. Both Dynamix Realty and Kripashankar sought to explain the transaction as a loan which had been repaid.
"Dynamix Realty had given a loan to Narendra Mohan Singh which has been repaid to the company on March 12, 2010," said a company spokesperson.
Narendra Mohan spoke in the same vein. "It's a fact that I had taken loan of Rs 4.5 crore from Dynamix Realty for business purpose. However, since our plan did not materialize, I returned the entire amount. All transactions are reflected in my accounts and I-T returns' books. It will be wrong to link the transaction with the 2G scam," Singh Jr told TOI.
He added that since he was entering into a business deal with Dynamix Realty, he had sought loan from the company.
Accordingly, between 2008 and 2009, a total of Rs 4.5 crore was paid to him. The first cheque of Rs 50 lakh was received by him on August 23, 2008, followed by another cheque of Rs two crore on June 1, 2009, and two more of Rs one crore each on February 10 and 27, 2009.
"It was a business proposal. Our transaction failed. Hence, I had to return the money. We repaid the entire amount before March 13, 2010," he said.
This is the second time that DB Realty has sought to explain transfer of funds to kin of politicians as related to business transaction that was later abandoned.
In the earlier instance, D B Realty was found to have transferred Rs 214 crore to Kalaignar TV, owned by second wife and daughter of Tamil Nadu chief minister M Karunanidhi.
The Enforcement Directorate, which uncovered the dealing, is probing whether the money deposited in Kaliagnar TV — a political project of DMK — was in exchange for the spectrum license that Karunanidhi's nominee A Raja had granted to Swan-promoted by Balwa.
D B Realty and Kalignar TV insist the money was for a business venture, which did not materialize, and it has been returned.

By Mohit sexena-New Delhi With Congress President Sonia Gandhi back from abroad today, the contentious issue of seat-sharing between the Congres and the Trinamool Congress for the upcoming West Bengal Assembly polls was put on fast-track with indications that the two parties are likely to work out their differences.
Sources also said the Congress high command is likely to abide by Trinamool chief Mamata Banerjee's decision to give her ally only 64 seats of the 294-seat Assembly. The Congress can get one more, sources said, taking its tally to 65.
Earlier in the day, a senior party leader had said the Congress has three lists ready, including one for all 294 constituencies.
Later in the day, Sonia Gandhi met Finance Minister Pranab Mukherjee and her Political Secretary Ahmed Patel and thrashed out the best way to resolve the issue. The Congress has all along wanted 90 seats but Mamata was ready to give only 64.
There was no official word about what transpired at the hour-long meeting between Gandhi and Mukhejee. Mukherjee then spoke to Banerjee on the phone and conveyed Gandhi's views on the issue.
In the morning, Congress leader Shakeel Ahmed had said the party wanted an alliance with the Trinamool Congress but at the same time had prepared a contingency plan to contest all Bengal seats.
Banerjee had sprung a surprise on the Congress on Friday by unilaterally announcing her party's decision to contest 228 seats.
Trinamool had made the announcement despite Congress seeking some more time as it could not reach a consensus on either the number of seats or the constituencies to be shared.
Acknowledging the stalemate, Ahmed today said, "We still do not have a consensus on the number of seats as well as the constituencies including some held by Congress. That's why there are differences in our perception.

By Mohit sexena-The Supreme Court on Saturday stayed the criminal proceedings against dentist couple Rajesh and Nupur Talwar in the case relating to the murder of their daughter Aarushi and domestic help Hemraj in 2008.
The court also asked the couple to surrender their passports before the trial court by Monday.
The bench of Justices B Sudershan Reddy and S S Nijjar stayed all the proceedings relating to the summoning of Talwar couple and bailable warrants issued against them by a Ghaziabad court.
Earlier in the day, the Talwars approached the apex court seeking stay of criminal proceedings against them in the case and challenging the order of the Allahabad High Court which refused to stay the proceedings before a special CBI court in Ghaziabad in the case.
The Allahabad High Court had yesterday dismissed their plea seeking quashing of the proceedings initiated by the lower court which not only refused the closure report of CBI but also summoned them as accused in the case.
The High Court had said that it cannot prohibit the magistrate from taking cognisance of a case if prima facie it appears that there is sufficient evidence against a person.
The High Court had asked Nupur, who submitted she had been summoned despite never having been called for interrogation or having been named as an accused in CBI's closure report, to appear before the trial court within two weeks.
Another petition filed by Rajesh Talwar challenging bailable warrants issued by the Ghaziabad court on February 28 was dismissed by Justice Ravindra Singh.

By Mohit sexena-TOKYO: A monster earthquake-cum-tsunami, followed by spiraling nuclear radiation, and now, the looming threat of an exodus from Japan. France on Wednesday became the first country to sound the alarm, saying Japan was losing control of the situation at the Fukushima nuclear power plant and there was no reason for optimism. As multinational corporations readied evacuation plans and China and India began special flights to bring back nationals who wished to return, France forcefully urged its nationals in Tokyo to leave the country or head to southern Japan to escape risk of radiation.
L&T Infotech on Wednesday became the latest Indian IT company to announce it's evacuating its 185 employees and their employees. And the Indian government began facilitating the return of its nationals even as it stressed there was no need for pulling out yet. Air India will operate a daily special flight for the next four days from Tokyo to Delhi for those willing to pay for their way out. India's ambassador to Japan Alok Prasad said the 25,000-strong community was in and around Tokyo; around 30 who had been stranded in worst-hit Sendai city had been brought to Tokyo.
Foreign firms have set up evacuation plans in Tokyo and parts of northern Japan. Peugeot, the French partner of Japanese carmaker Nissan Motor, said around 230 employees had been given the opportunity to leave with their families. Rival Daimler said the evacuation of the families of 60 expat workers was being arranged.
"Let's not beat about the bush. They have visibly lost the essential of control (of the situation). That is our analysis, in any case, it's not what they are saying," French industry minister Eric Besson said on TV. Environment minister Nathalie Kosciusko-Morizet backed him, saying the situation in Japan was a "catastrophe" and the latest information on Wednesday "does not lead to optimism". France, however, clarified that there was no official evacuation
